Effective date: 13 August 2026 Last updated: 13 August 2026
1. About these Terms
These Terms and Conditions govern your access to and use of the CALCPAD website, online platform, calculators, assessment tools, models, reports, templates, dashboards, information resources and related digital services (collectively, the Platform).
The Platform is operated by CALCPAD ACCOUNTING AND CONSULTING PROPRIETARY LIMITED (ABN 23 646 714 810), trading as CALCPAD (CALCPAD, we, us, our).
By accessing or using the Platform, you agree to these Terms.
Where CALCPAD is separately engaged to provide Fractional CFO, accounting, commercial, risk management, strategy, consulting or other professional services, those services may also be governed by a separate proposal, engagement letter, statement of work or other agreement. If there is an inconsistency, the specific engagement terms will prevail in relation to those professional services.
2. The CALCPAD Platform
CALCPAD provides business tools designed to assist users with activities including financial analysis, business planning, risk assessment, strategy, compliance management, scenario modelling and decision support.
The Platform may include:
- financial and commercial calculators;
- risk and governance assessments;
- benchmarking tools;
- scenario and forecasting models;
- downloadable reports and workpapers;
- business process and compliance tools;
- educational and reference material; and
- other functionality introduced from time to time.
Features may be added, modified, withdrawn or replaced as the Platform develops.
3. Decision-support tools — not a substitute for professional advice
Unless expressly stated in a separate professional engagement, information and outputs produced by the Platform are general information and decision-support tools only.
They do not constitute legal, accounting, taxation, audit, financial product, investment, employment, engineering or other regulated professional advice.
Calculations and assessments may depend upon:
- information entered by the user;
- assumptions incorporated into a model;
- legislation, rates or thresholds current at a particular date;
- simplified representations of complex circumstances; and
- third-party information.
You should consider whether independent professional advice is appropriate before relying on an output for a material business, legal, financial, taxation, investment or compliance decision.
Where CALCPAD separately provides professional advisory services, the scope and responsibility for that advice will be governed by the applicable professional engagement.
4. Accuracy and currency
CALCPAD aims to provide useful and reliable tools, but no model can address every factual circumstance.
You are responsible for reviewing:
- the accuracy and completeness of information entered into the Platform;
- assumptions used in calculations;
- the stated effective date of rates, thresholds or legislative information;
- the relevance of an output to your circumstances; and
- material results before they are relied upon.
Legislation, tax rates, regulatory requirements, economic assumptions and other reference data may change.
The Platform should not be assumed to contain the most current information unless the relevant tool expressly identifies its source and effective date.
5. Accounts and access
Some parts of the Platform may require registration.
You are responsible for:
- providing accurate account information;
- maintaining the confidentiality of your login credentials;
- using reasonable security practices;
- restricting access to authorised users; and
- promptly notifying CALCPAD if you believe an account has been compromised.
You must not knowingly permit another person to access an account contrary to the applicable subscription or licence terms.
6. Acceptable use
You must not use the Platform:
- unlawfully or fraudulently;
- to interfere with its security or operation;
- to attempt unauthorised access to systems, accounts or information;
- to introduce malicious software or harmful code;
- to scrape, copy or systematically extract substantial Platform content without permission;
- to reverse engineer protected components except where permitted by law;
- to impersonate another person or organisation;
- to process information you are not authorised to possess or use; or
- in a manner that infringes another person's intellectual property, privacy or other rights.
CALCPAD may restrict or suspend access where reasonably necessary to protect users, information, systems or legal rights.
7. Client information
You remain responsible for determining what information you enter or upload to CALCPAD and ensuring you have authority to use that information.
Where you enter information concerning employees, customers, suppliers, clients or other individuals, you are responsible for ensuring that your collection and disclosure of that information is lawful.
Ownership of your underlying business data remains with you or its existing owner.
You grant CALCPAD the limited rights reasonably necessary to host, process, calculate, store, back up and present that information for the purpose of providing the Platform and related services.
8. Intellectual property
Unless otherwise stated, CALCPAD owns or licenses the intellectual property in the Platform, including its software, models, calculation methodologies, workflows, assessment structures, reports, templates, branding, graphics and written materials.
Your use of CALCPAD does not transfer ownership of that intellectual property.
Subject to these Terms and any applicable subscription, CALCPAD grants you a limited, non-exclusive and non-transferable right to use Platform outputs for your own internal business purposes.
You may generally use reports generated specifically from your own data for legitimate internal business purposes and professional communications.
You must not commercially reproduce, resell, sublicense or create a competing product substantially derived from CALCPAD proprietary tools or content without written permission.
9. Third-party information and services
CALCPAD may use or refer to information, software, data, websites or services provided by third parties.
CALCPAD does not control those third parties and is not responsible for their independent acts, omissions, availability, security or privacy practices.
Reference to a third-party service does not necessarily constitute endorsement.
10. Artificial intelligence and automated processing
CALCPAD may from time to time incorporate automated analytical or artificial intelligence functionality.
Where such functionality is used, its output should be treated as analytical assistance rather than independently verified fact unless CALCPAD expressly states otherwise.
Users remain responsible for reviewing material outputs before relying upon them.
CALCPAD will not intentionally use confidential client information to train publicly available artificial intelligence models unless this has been expressly disclosed and appropriately authorised.
11. Subscriptions and payment
Certain services may be offered free of charge and others may require payment.
The applicable price, subscription period, inclusions, renewal arrangements and cancellation rights will be displayed before purchase or specified in an engagement or order.
Unless otherwise stated, prices are in Australian dollars and GST will be dealt with in accordance with Australian law.
Nothing in these Terms excludes rights that cannot lawfully be excluded.
12. Availability
CALCPAD aims to maintain reasonable Platform availability but does not guarantee continuous or uninterrupted access.
Access may be interrupted because of maintenance, upgrades, technical failure, cyber-security incidents, third-party service interruptions or circumstances outside CALCPAD's reasonable control.
Where practicable, CALCPAD will seek to minimise material interruptions.
13. Liability
To the maximum extent permitted by law, CALCPAD excludes liability for loss arising solely from:
- inaccurate or incomplete information supplied by a user;
- reliance upon a Platform output without appropriate consideration of its assumptions or limitations;
- decisions made outside the scope of an applicable professional engagement;
- unauthorised use of an account;
- third-party systems or services; or
- circumstances outside CALCPAD's reasonable control.
Where liability cannot lawfully be excluded, CALCPAD's liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including applicable rights under the Australian Consumer Law.
14. Indemnity
To the extent permitted by law, you are responsible for loss reasonably incurred by CALCPAD resulting from your unlawful use of the Platform, infringement of another person's rights, or material breach of these Terms.
This clause does not require you to indemnify CALCPAD for loss caused by CALCPAD's own negligence, wrongful act or breach of law.
15. Suspension and termination
You may stop using the Platform at any time, subject to any existing contractual or subscription commitments.
CALCPAD may suspend or terminate access where reasonably necessary because of:
- material breach of these Terms;
- non-payment;
- unlawful or abusive activity;
- a material security risk; or
- discontinuation of the relevant service.
Where reasonable in the circumstances, CALCPAD will provide notice and an opportunity to remedy a breach before termination.
16. Privacy and data security
Personal information is handled in accordance with the CALCPAD Privacy Policy.
CALCPAD's approach to information security is further described in its Data Security & Compliance Policy.
17. Changes to these Terms
CALCPAD may update these Terms as the Platform, business or applicable laws develop.
Material changes will take effect prospectively and, where appropriate, will be communicated to registered users.
The current version will be published on the CALCPAD website.
18. Governing law
These Terms are governed by the laws of Victoria, Australia.
The parties submit to the courts of Victoria and courts having appellate jurisdiction from those courts, subject to any mandatory jurisdiction provided by applicable law.
